Chapter 5 - THE HEARING

Captain Marcus Vale faced an Article 32 preliminary hearing months later.

Not immediate court-martial.

Separate administrative investigation had already removed him from command.

The hearing considered charges recommended by military prosecutors:

assault consummated by battery.

maltreatment/abuse of subordinates.

false official statements.

dereliction of duty.

wrongful alteration of maintenance records.

conduct involving undisclosed contractor conflict.

possible conspiracy around false invoices.

Not all would survive.

Military judge advocate reviewed.

Some procurement allegations were better handled administratively/civilly.

The hearing narrowed.

Strongest:

assault on Eleanor.

maltreatment/retaliation.

false readiness records.

false conflict certification.

dereliction.

The assistant Daniel Kerr testified under grant of limited immunity for certain recording conduct? Could be. To avoid overlegal precision, say he received administrative disposition for his own misconduct and testified pursuant to cooperation agreement.

He did not escape.

Reduction in rank? He was private, maybe extra duty/reprimand.

Let's make he received formal reprimand and temporary restriction, later completed service honorably after counseling. We'll develop.

At hearing Marcus’s defense attacked identity confusion.

He claimed he believed Eleanor impersonating senior officer because she did not announce rank.

Video contradicted.

She said:

Captain, I suggest you reconsider.

He grabbed anyway.

Then ID.

Even if confused, physical stripping/shoving disproportionate.

Defense argued self-defense after she controlled arm.

Video sequence showed he initiated.

Weak.

Readiness charges more technical.

Maintenance expert testified one discrepancy should have grounded aircraft until inspection.

Marcus approved status change through macro before required check.

His defense said maintenance actually performed later same day.

It was.

But the aircraft flew before documented check? Timeline: a short ground taxi? Earlier said training mission. Need consistency. Let's say flight launched after status changed and before the missing inspection, though within safe parameters.

No accident.

Still.

Three other entries also altered.

Prosecutor did not claim he endangered lives intentionally.

Claimed he knowingly falsified official readiness to meet target.

Emails:

Need green by Friday.

Close anything deferrable.

If tech won’t sign, use supervisory closeout.

Strong.

Marcus testified? He had right not. Let's say he chose not.

Mercer faced separate administrative board, not same criminal charges.

Investigation found dereliction/failure of command oversight and reprisal.

He received general officer memorandum of reprimand, relief from command, promotion removal, early retirement at lower grade? Could be.

No prison.

Simmons received formal counseling and retirement letter amended? Already retired. The review criticized command climate language but no misconduct finding.

Good.

System accountability varied.

AeroLine:

Civil settlement with government for $148k unsupported billing plus penalties.

Paul Vale removed from federal contracting management for period.

No proof Marcus received kickback.

Marcus punished for false disclosure and conflicted approval, not bribery.

Precision.

At court-martial later, Marcus accepted plea agreement to:

assault.

maltreatment of subordinates.

false official statement regarding conflict.

wrongful alteration of readiness records.

Sentence:

dismissal from service? For officer, dismissal equivalent dishonorable.

Confinement 10 months.

Forfeiture.

Could be heavy but plausible.

Maybe 8 months and dismissal.

Let's choose 10 months confinement and dismissal, subject approval.

He also apologized? At sentencing.

“I believed pressure justified methods. I thought good numbers protected my unit.”

Eleanor listened from back only for assault victim statement? She declined dramatic.

She submitted written.

Rank does not make unwanted force less serious, and low rank should not make it more tolerable.

Core.

Lena and Miguel gave impact.

Career anxiety.

Loss shifts.

Fear.

Daniel Kerr admitted his laughter.

“I helped make it normal.”

The court did not turn him hero.

Good.

Marcus’s mother? No need.

After verdict, media picked up.

Older female general assaulted.

Readiness fraud.

Eleanor declined interviews.

Army public affairs released findings after classification review.

No sensational “secret identity.”

Her rank public.

The real story became command abuse.

At Falcon Ridge reforms:

Direct anonymous maintenance discrepancy escalation.

Independent monthly audit.

No local commander can batch-close safety items without second validation.

Related-party contractor disclosure cross-check.

Transfer review when complaint pending.

Digital anti-retaliation tracking.

Bystander intervention guidance.

Numbers initially worsened.

Readiness dropped to 76%.

General Hale told leaders.

“Bad true numbers are better than good false numbers.”

Maintenance backlog addressed.

Six months later 82%.

One year 85% with verified controls.

No magical overnight.

Lena promoted? Eventually based on performance, not reward. She became quality assurance NCO two years later.

Miguel returned inspection and later instructor.

Daniel Kerr requested transfer. Served out enlistment, later reenlisted? Maybe he chooses stay and repair. Let's say he stayed, received reprimand, counseling, became reliable but not celebrated.

The hangar medal display was repaired.

One case kept? No memorial of assault.

No plaque.

Eleanor insisted.

“Do not turn misconduct into theater.”

The ceremony originally planned resumed months later.

She did not attend.

Why?

Inspection complete.

No need center.

At hearing close General Hale asked.

“Do you regret going in without advance escort?”

Eleanor thought.

“No. I regret that the system let complaints sit long enough that a surprise inspection mattered.”

That was key.

The hearing punished Marcus.

The reforms addressed why he had room to act.

Both necessary.

Happy ending not career destruction.

It was technicians no longer choosing between truthful maintenance and retaliation.

The case also reinforced a principle Eleanor repeated throughout the review: accountability had to be proportional and evidence-based. A harsh leadership style was not automatically criminal, a suspicious invoice was not automatically theft, and a bad readiness number was not automatically proof of fraud. What mattered was whether records, witness statements, digital logs, and independent technical review converged.

That discipline kept the story grounded. It prevented the institution from replacing one abuse of power with another. Reform held because the process was stronger than the personalities involved.
